This Acceptable Use Policy (AUP) governs the use of WisdomCybernetics web hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and WisdomCybernetics regarding the interpretation of this AUP, WisdomCybernetics’ interpretation, in its reasonable commercial judgment, shall govern. 1. Offensive Content
You may not publish or transmit via WisdomCybernetics service any content that WisdomCybernetics reasonably believes:
- Constitutes child pornography.
- Constitutes illegal pornography.
- Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech.
- Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes.
- Is defamatory or violates a person’s privacy.
- Creates a risk to a person’s safety or health, or to public safety or health.
- Compromises national security or interferes with an investigation by law enforcement.
- Improperly exposes trade secrets or other confidential or proprietary information of another person.
- Is intended to assist others in defeating technical copyright protections.
- Clearly infringes on another person’s trade or service mark, patent, or other property right.
- Promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking.
- Is a peer-to-peer file sharing application that demands high bandwidth and CPU resources, which negatively affects other customers and is therefore not permitted.
- Is otherwise illegal, malicious, fraudulent, or solicits unlawful conduct.
- Use of IRC except on services specifically designated for IRC access.
“Published or transmitted” via WisdomCybernetics service includes web content, email, bulletin-board postings, chat, and any other type of posting or transmission that relies on any internet service provided by WisdomCybernetics.
2. Security
You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically.
3. Bulk Commercial Email
You must obtain WisdomCybernetics’ advance approval for any bulk commercial email, which will not be given unless you can demonstrate all of the following:
- Your intended recipients have given consent to receive email through some affirmative opt-in procedure.
- Your consent procedures verify the person opting in is the actual owner of the email address.
- You retain consent evidence and produce it within 72 hours of any request.
- The email body describes how the address was obtained and how to request consent evidence.
- Recipients can easily revoke consent — for example, via an unsubscribe link — and revocations are honored within 72 hours.
- You publish an abuse@yourdomain.com address on the first page of any associated website, register it at abuse.net, and respond promptly to messages there.
- You publish a Privacy Policy for each domain associated with the mailing.
- You can track anonymous complaints.
- You do not obscure the source of email; the recipient’s address must appear in the To line or message body.
- You comply with the CAN-SPAM Act and all other applicable laws.
These rules apply to messages sent through your WisdomCybernetics service or sent from any network that directly or indirectly refer recipients to a site hosted with us. WisdomCybernetics may test and otherwise monitor your compliance, including requesting opt-in evidence from random samples of your list.
4. Unsolicited Email
You may not send any unsolicited email, in bulk or individually, to any person who has indicated they do not wish to receive it. You must comply with the rules of any other network you use through your WisdomCybernetics service.
5. Material Protected by Copyright
You may not publish, distribute, or otherwise copy any music, software, art, or other work protected by copyright law unless you have express authorization from the copyright owner or you are otherwise permitted under United States copyright law. WisdomCybernetics will terminate the service of repeat copyright infringers.
6. Copyright Infringement Notices (DMCA)
If you believe your copyright is being infringed by a person using the WisdomCybernetics network, send a written notice of copyright infringement to abuse@wisdomcybernetics.com. Your notice must include:
- A physical or electronic signature of a person authorized to act for the rights owner.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material claimed to be infringing, with information sufficient for us to locate it.
- Information sufficient to contact you (address, phone, email).
- A good-faith statement that the use is not authorized by the rights owner, agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and you are authorized to act on the rights owner’s behalf.
7. IRC
WisdomCybernetics strictly prohibits the use of any IRC client or server process running on our network unless installed and running on an IRC-allowed VPS or dedicated server (IRC64MB, IRC128MB, IRC256MB).
8. Other Requirements
You must keep valid and current information on file with your domain name registrar for any domain hosted on the WisdomCybernetics network.
9. Disclaimer
WisdomCybernetics is under no duty, and does not by this AUP undertake a duty, to monitor or police customer activities, and disclaims responsibility for any misuse of the WisdomCybernetics network.
10. Internet Abuse
You may not engage in illegal, abusive, or irresponsible behavior. WisdomCybernetics may terminate service for any customer without refund for behavior including:
- Unauthorized access to or use of data, systems, or networks; probing or testing vulnerabilities or breaching security without authorization.
- Monitoring data or traffic on any network or system without the owner’s authorization.
- Interfering with service to any user, host, or network — including mail bombing, flooding, deliberate overload, and broadcast attacks.
- Use of an internet account or computer without the owner’s authorization (password robbery, port scanning, etc.).
- Forging any TCP/IP packet header or part of the header information in an email or newsgroup posting.
- Any conduct likely to result in retaliation against the WisdomCybernetics network.
- Use of the network in a way that unreasonably interferes with other customers’ use.
- Threatening or acting inappropriately toward WisdomCybernetics staff.
11. Newsgroups, Chat Forums, Other Networks
You must comply with the rules and conventions for postings to any bulletin board, chat group, or other forum — including IRC and USENET groups — covering content and commercial postings. These groups generally prohibit off-topic commercial messages or mass postings to multiple forums.
